Review cannot reopen entire case after concurrent findings by three courts: Supreme Court

ISLAMABAD, (APP - UrduPoint / Pakistan Point News - 7th Oct, 2026) The Supreme Court has held that where the judgments of three courts have gone against a party, the entire case cannot be reopened in review proceedings.

The court dismissed a review petition filed by advocate Ghulam Mustafa Kundwal but withdrew an order imposing a fine of Rs 25,000 on him during the hearing.

During the proceedings, Justice Naeem Akhtar Afghan observed that judgments of three courts had gone against the petitioner and that the Supreme Court had also not allowed reopening the matter in review. He stated: "You cannot reopen the entire case now."

Justice Naeem Akhtar Afghan further noted that review petitions were filed against every judgment of the Supreme Court.

A heated exchange also took place between advocate Ghulam Mustafa Kundwal and the judges during the hearing. The counsel argued that he was a senior lawyer and expressed frustration with the court not listening to him, adding that he had more arguments to present. Justice Jamal Mandokhail responded that the court had already heard his arguments.

When Justice Jamal Mandokhail suggested increasing the fine if Ghulam Mustafa Kundwal continued arguing, the counsel replied: "You may impose a fine equal to my entire fee, but please hear me. This is what we still expect from the Supreme Court." Justice Jamal Mandokhail expressed disappointment over the counsel's conduct, stating that he was saddened by his attitude.

The court had imposed a fine of Rs 25,000 on the counsel during the proceedings. However, while dismissing the review petition, it withdrew the order imposing the fine.
