National Assembly rules require the speaker’s approval before any member can be arrested, even in a criminal case, while debating the Constitution and law with those whose only merit is friendship is meaningless; post.

ISLAMABAD (UrduPoint) - Following Interior Minister Mohsin Naqvi’s criticism of the requirement for prior speaker approval before lawmakers are arrested in the Khyber Pakhtunkhwa Assembly, journalist Majid Nizami took him to task by citing constitutional and legal provisions.

Journalist and analyst Majid Nizami shared a social media post mocking Interior Minister Mohsin Naqvi’s constitutional knowledge, writing: "عقل نہیں تے موجاں ای موجاں".

He pointed out that Rule 103 of the National Assembly Rules of Procedure clearly states that even in a criminal case, prior formal approval from the National Assembly speaker is constitutionally and legally required before any member of the National Assembly can be arrested.

Questioning Mohsin Naqvi’s qualifications and position, the journalist further wrote: "Anyway, debating the Constitution and law with those whose only merit is friendship is completely meaningless and futile."

It may be recalled that Interior Minister Mohsin Naqvi had earlier criticized a letter sent by the Khyber Pakhtunkhwa Assembly Secretariat to the inspector general of police, asking whether police would also wait for the speaker’s permission to arrest an MPA if the lawmaker were nominated in a criminal offence or murder case. Journalistic and constitutional circles have since been reminding him of the constitutional and legal limits governing assemblies.
