KP Chief Minister Dispute: Sohail Afridi Served Notice on Sher Afzal Marwat’s Petition

Imran Khan's conviction and subsequent disqualification have sparked a legal battle over the election of Khyber Pakhtunkhwa (KP) Chief Minister. Sher Afzal Marwat argues that Sohail Afridi's appointment was unconstitutional, as per his petition before the Constitutional Court.
The Federal Constitutional Court has summoned all parties involved, including incumbent KP CM Sohail Afridi and the Attorney General, for formal responses to Marwat's petition. The court heard initial arguments from Marwat, who claimed that Imran Khan's conviction under Articles 62 and 63 of the Constitution barred him from influencing the selection of a new chief minister.
Marwat asserted that Ali Amin Gandapur's resignation was coerced by instructions attributed to Imran Khan, contradicting constitutional procedures and Supreme Court rulings. He deemed Afridi's appointment as unconstitutional from its inception, citing the governor's failure to accept Gandapur's initial resignation before receiving a handwritten second one.
Sher Afzal Marwat further maintained that Gandapur has not been formally removed from office, rendering any subsequent appointments unconstitutional. The court acknowledged the case's significance in interpreting provincial administration and constitutional provisions, and issued a notice to the Attorney General.
The Constitutional Bench requested parties' concerns and written responses, postponing further proceedings until mid-October.
