Government to File Review Petition Against Supreme Court Order on Imran Khan’s Medical Examination

Federal Minister for Law and Justice Senator Azam Nazeer Tarar stated on Tuesday that the government intended to file a review petition against the Supreme Court’s order concerning the medical examination of PTI founder Imran Khan.

Speaking in Islamabad, Tarar explained that this decision was reached after discussions with jail authorities and the Islamabad administration, coupled with a thorough review of the legal implications of the court’s directive.

He argued that directing the examination at Shifa International Hospital was inconsistent with the existing framework governing medical treatment for prisoners. According to Tarar, the government would request the Supreme Court to modify its order, allowing the examination to be conducted at a government-run tertiary care hospital. He suggested including medical experts from Shifa International Hospital or another prominent institution if deemed necessary by the court.

Tarar highlighted potential legal and administrative challenges that could arise from permitting private hospitals to conduct such examinations for prisoners. He noted that medical boards typically determine whether a prisoner’s treatment requires transfer to a hospital, with government facilities usually serving as the preferred option unless specific evidence indicates otherwise.

The minister also sought clarification on the scope of the Supreme Court’s order, inquiring whether it would apply only to Imran Khan’s case or set a precedent for prisoners nationwide. He revealed that the government’s legal team had analyzed these issues and decided to approach the Supreme Court to resolve ambiguities and ensure adherence to constitutional and legal principles.
